Welcome to Picatoo

Picatoo allows its members to upload, store, and process their digital images. This serves as an agreement between the customer, and Picatoo, for strict compliance, to ensure that Picatoo continues to operate and function successfully. The following guidelines stipulated below are binding on all users and customers of the website. All users who visit any part of this website is deemed to have agreed to and understood the terms identified herein.

Membership Terms

Anyone may become a member and avail of the services provided by Picatoo, provided that they submit the information required of them in order to create an account with Picatoo. These may include, but are not limited to the following: name, mailing address, email address, and other contact information. Picatoo adheres to strict confidentiality and will not disclose, transfer or convey the information users provide to third parties.

A registered account with Picatoo serves as a license for customers to use the site in personal and non-commercial pursuits, unless the customer has an existing business relationship with Picatoo.

Picatoo reserves the right to terminate any user’s membership account upon its sole discretion. Any member who violated any of the terms stipulated in this document may be meted a warning, temporary suspension, or complete termination of his account. User accounts without activity for one year will be considered inactive and will therefore be terminated. In the case of account termination, Picatoo will delete from its system all content posted by the terminated user.

Users may receive unsolicited emails from time to time that Picatoo feels would be of interest to them.

Use of Website Services

Picatoo is a service that allows users to upload, store, and process their own digital photographs. It is the user’s responsibility to manage his account and the allotted storage space provided for his use. It is also the user’s responsibility to make original or back-up copies of his digital images and Picatoo must not be used as the sole storage medium. Picatoo will not be responsible for lost images in the user’s account that he was not able to store in another medium. Moreover, this service is provided for personal use and non-commercial only.

The usage of Picatoo must only be for lawful and non-commercial purposes. Thereby users are prohibited from posting content that are unlawful, illegal, defamatory, malicious, hateful, discriminating, obscene, punishable by law and any objectionable material of any kind depicting child pornography, hate crimes, extreme violence, racial discrimination, substance abuse, and the like. Users are also prohibited from posting copyrighted images. Picatoo is not to be held responsible in cases when copyright images are processed for printing. The users are deemed to be owners of the images they provide and Picatoo reserves the right to delete copyright-protected digital images which have been uploaded without the authors’ written consent, and to filter other content posted by its users and restrict those that are deemed harmful to its other users and stakeholders.

The services provided by Picatoo is restricted for personal use only. Hence, users cannot reproduce, duplicate, resell, or exploit the services provided by Picatoo. Using the site for commercial purposes is subject to an existing business relationship between the user and Picatoo.

By agreeing to the terms and conditions set herein, the user grants Picatoo a universal, royalty-free, and non-exclusive privileges to display, copy, modify, resize, and distribute the content uploaded by the user.

Restrictions

Users are free to access any part of the website that is allowable to the public. The following restrictions, however, unconditionally apply:

Users are prohibited from making commercial use of Picatoo. Membership cannot be used for reproducing or reselling the services available in the online store.

Users are prohibited from obtaining, through any legal or illegal means, data and information about other users registered with Picatoo. Users are moreover prohibited from processing the content of other users registered with the site.

Users are prohibited from using any automated and electronic means, whether legal or illegal in nature, to access the website’s systems and data. Moreover, users are prohibited from attempting to bypass, through any means, the security measures implemented to protect the website. Any attempt to interfere with website operations is subject to the suspension or termination of the accountable user’s account.

Suspension and Termination

Picatoo reserves the right to suspend and terminate the account and usage privileges of any customer who violates the terms and conditions enumerated in this document. Any user’s right to access the site and its services may be revoked upon the discretion of Picatoo.

The online store will warrant a warning, a temporary suspension, or permanent termination notice to the user through email. The user will be informed of the reasons for the suspension. During the suspension period, the user may not access any portion of the website. In addition, he cannot create a new account, cannot make purchases, cannot receive primary and supplementary services and notices from Picatoo, and cannot engage in commercial dealings with the merchant.

User Accountability

The users are responsible for keeping their passwords confidential and secure. They are likewise accountable for maintaining the email addresses affiliated with their accounts. Picatoo is not responsible for the user’s failure to receive notifications in his specified email address. Users are solely responsible for maintaining and updating their account as deemed necessary. The users are likewise responsible for all the activities in their respective accounts. Through agreeing to this document, the user likewise agrees to receive notifications from (website name).

Privacy and Confidentiality of Data and Content

All data submitted by users to Picatoo remains confidential and can only be accessed by designated members of Picatoo’s team. No data will be disclosed, transferred or conveyed to any third party for private, commercial, or legal (i.e., user is under investigation, involved in a court case) purposes, unless otherwise required by law or the courts, for any legal purposes.

All content posted by the users of Picatoo remains confidential and can only be accessed by designated members of Picatoo’s team and other parties that the user grants permission to. As an exception, content will only be shared to a third party printer, as it is required for the processing and printing of the content, should the user desire to have his images printed.

Disclaimers

Picatoo will not be responsible for the users’ exposure to content that they may personally find offensive.

All images stored in Picatoo are properties of their respective owners, with Picatoo entitled to rights to display, modify, resize, and distribute them. Picatoo will not be held liable for the processing and printing of copyrighted images.

Third Party Applications

Picatoo uses other third party software to perform its functions. Picatoo does not warrant that third party software shall perform according to the provider’s specifications or accept any liability for problems that users may experience from their use. We require Picatoo users to install Sun Microsystems' Java software (http://java.sun.com) on their PC. This software helps users upload images easily to the Picatoo website simply by dragging-and-dropping pictures to the browser, but is not intended for any other purpose.

Acknowledgement

The aforementioned terms represent an agreement between Picatoo and the user. All visits and access to the site are subject to these conditions. By accessing this site, the user agrees to all the terms and conditions of use set by Picatoo.

Picatoo’s terms and conditions are subject to change without prior notice.
